Please read this Agreement carefully before using zyttle. By creating an account or using our Platform, you covenant and agree to be legally bound by these Terms of Service and our Privacy Policy (together, the "Agreement"). If you do not agree, do not use zyttle. zyttle is operated as a website and mobile application by Guaico LLC.
zyttle is a web and mobile platform operated by Guaico LLC, a limited liability company organized under the laws of the State of North Carolina ("Company," "we," "us," or "our"). zyttle connects families seeking childcare with sitters in their local neighborhood (the "Platform").

By accessing or using the zyttle Platform — including our website, mobile application, and any related services — you hereby covenant, agree, and represent that you have read, understood, and accepted these Terms of Service and our Privacy Policy (collectively, the "Agreement"). This Agreement is a binding legal contract between you and Guaico LLC.
Who can enter this Agreement. You may enter into this Agreement only if you are eighteen (18) years of age or older and have the legal capacity to form a binding contract.
Teen Sitters do not enter this Agreement. Sitters under the age of eighteen (18) ("Teen Sitters") are not parties to this Agreement, do not accept its terms, and do not make any legally binding covenants by using the Platform. A parent or legal guardian ("Guardian") of the Teen Sitter must enter into this Agreement on the Teen Sitter's behalf and remains the sole responsible party for the Teen Sitter's use of the Platform.
Guardian acceptance. If you are the Guardian of a Teen Sitter, you hereby covenant, agree, and represent — affirmatively and on behalf of the Teen Sitter — that (a) you have read, understood, and accepted this Agreement; (b) you authorize the Teen Sitter to use the Platform under your supervision; (c) you accept all obligations, duties, and liabilities that this Agreement assigns to the Teen Sitter as if they were your own; and (d) you will supervise the Teen Sitter's use of the Platform on an ongoing basis.
If you do not agree to be bound by this Agreement, you may not access or use the Platform.
To create an account on the Platform, the following requirements apply:
Teen Sitter activation. A Teen Sitter's profile does not become active on the Platform until the Guardian has completed our Guardian approval process, which constitutes the Guardian's affirmative acceptance of this Agreement on the Teen Sitter's behalf. The Guardian's approval is a logged, time-stamped, and revocable consent — see Section 5.2.
Adult Sitter verification. Adult Sitters complete identity verification and may complete an optional third-party background check before their profile becomes active. The availability and outcome of any background check is governed by the third-party provider and is not a representation or warranty by zyttle. See Section 7.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Guardians are additionally responsible for all activity that occurs under the Teen Sitter's account.
Parents and Families. You hereby covenant and agree that:
Adult Sitters. You hereby represent, covenant, and agree that:
Guardians of Teen Sitters. If you are the Guardian of a Teen Sitter, you hereby represent, covenant, and agree that:
Teen Sitters — Platform conduct (not contractual). The Platform expects Teen Sitters to communicate respectfully, attend confirmed bookings, and follow their Guardian's directions. These expectations are conditions of continued Platform access, enforced through the Guardian's responsibility, and are not legally binding covenants of the Teen Sitter.
All Users. You hereby covenant and agree to treat every person on the Platform — children, parents, sitters, and Guardians alike — with respect, dignity, and professionalism.
You hereby covenant and agree not to use zyttle to:
Violation of these rules may result in immediate suspension or permanent removal from the Platform. Two or more reports from other users will trigger an automatic suspension pending review by our team.
A Guardian may withdraw their consent to a Teen Sitter's use of the Platform at any time, for any reason. To withdraw consent, the Guardian must notify zyttle in writing at hello@zyttle.com.
Upon receipt of a withdrawal notice, zyttle will suspend or disable the Teen Sitter's account and remove the Teen Sitter from active search results. Any bookings already confirmed at the time of withdrawal will be handled at zyttle's discretion, in consultation with the Guardian, the parent who booked, and (where appropriate) the Teen Sitter.
Guardian withdrawal does not relieve the Guardian of obligations or liabilities incurred under this Agreement prior to the withdrawal.
zyttle may also independently suspend or disable a Teen Sitter's account if we have reason to believe the Guardian's consent is no longer valid or has been revoked.
Booking Fees. Parents on the free plan are charged a $3.99 per-booking service fee. Premium members ($9.99/month) have this fee waived. zyttle collects a percentage of each completed booking as a platform fee.
Payments. All payments are processed through Stripe, Inc. ("Stripe"). zyttle does not store your full payment card information. You hereby covenant, agree, and warrant that you have read, understood, and accepted Stripe's then-current Terms of Service and Privacy Policy, as updated from time to time, as a condition of using any payment feature of the Platform. Adult Sitters who receive payouts additionally hereby covenant, agree, and warrant that they have read, understood, and accepted Stripe's Connected Account Agreement and any related Stripe terms governing the receipt of funds.
Cancellation Policy. Cancellations made more than 24 hours before a scheduled booking, or more than 1 hour before a same-day booking, are charged the booking fee only. Cancellations made within those windows are charged the booking fee plus one hour at the sitter's hourly rate. The sitter always receives that one-hour payment. Premium members receive one free late cancellation per calendar month, in which case no late-cancellation charge applies.
Sitter Cancellations. When a sitter cancels a confirmed booking, the parent receives a full refund, including the booking fee. Repeat sitter cancellations may result in account suspension.
Parent No-Show. If a parent fails to be present at the agreed booking location and time, the sitter may mark the booking as a parent no-show. In that case, the pending payment authorization on the parent's payment method will be released and no charge will be made for the session. The no-show event is recorded on the parent's account for future reference, and repeat no-shows may result in account suspension.
Sitter No-Show. If a sitter fails to attend a confirmed booking, the parent receives a full refund, and the sitter's account may be suspended pending review.
Disputes. If you have a dispute regarding a charge, please contact us at hello@zyttle.com within seven (7) days of the booking. We will review disputes in good faith but make no guarantees of refunds outside our stated policy.
zyttle relies on certain third-party providers to operate the Platform, including:
Covenant to read and accept third-party terms. You hereby covenant, agree, and warrant that you have read, understood, and accepted the then-current terms of service, privacy policies, and any other applicable agreements of each third-party provider that the Platform uses to deliver a service to you, as those terms and policies are updated from time to time. This covenant applies whether or not zyttle provides a link to the third-party provider's documents, and you remain responsible for reviewing those documents directly.
No representation by zyttle. zyttle makes no representation, warranty, or guarantee regarding the accuracy, completeness, timeliness, or results of any third-party verification, including but not limited to identity verification, background checks, or sex offender registry screening. The presence or absence of any verification badge, status, or label on a sitter profile reflects only the outcome reported to zyttle by the third-party provider at a point in time and is not a representation by zyttle that any sitter is safe, suitable, or free from risk.
Sitter direct relationship with payment providers. Adult Sitters who receive payouts establish a direct contractual relationship with Stripe through Stripe's Connected Account Agreement. zyttle is not a party to that agreement, and zyttle is not responsible for any dispute, delay, error, or interruption in payouts arising from the relationship between an Adult Sitter and Stripe.
You release zyttle from third-party claims. You hereby release zyttle from any claim, dispute, or liability arising from the acts, omissions, errors, or outcomes of any third-party provider, and you agree to pursue any such claim directly against the third-party provider.
⚠️ IMPORTANT: zyttle is a technology platform that connects families with sitters. We are not a childcare agency, staffing company, or employer of any sitter listed on the Platform.
Guaico LLC and zyttle expressly disclaim all liability for any injury, harm, loss, damage, or incident — including but not limited to personal injury, property damage, theft, or emotional distress — that occurs before, during, or after a booking arranged through the Platform.
We do not employ sitters. We do not supervise bookings. We do not guarantee the quality, safety, or suitability of any sitter for any particular family or situation. The relationship between a family and a sitter is entirely independent of zyttle.
While we take meaningful steps to verify Adult Sitters through optional background checks and require Guardian acceptance on behalf of Teen Sitters, no verification process is perfect or complete. You are solely responsible for your own due diligence when selecting a sitter, including meeting them before their first booking, checking references, and exercising your own judgment.
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
You hereby covenant and agree to indemnify, defend, and hold harmless Guaico LLC, its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
To the maximum extent permitted by applicable law, Guaico LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising from:
In no event shall our total liability to you for all claims exceed the greater of (a) the total fees paid by you to zyttle in the six months preceding the claim, or (b) one hundred dollars ($100).
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the fullest extent permitted by law.
The zyttle name, logo, platform design, and all associated content are the property of Guaico LLC and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Platform without our express written permission.
By submitting content to the Platform (including profile photos, reviews, or messages), you grant Guaico LLC a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content in connection with operating the Platform.
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into this Agreement by reference. Please review it carefully — it explains how we collect, use, and protect your personal information, including information relating to minors.
We take the privacy of minors seriously. zyttle is designed to comply with the Children's Online Privacy Protection Act (COPPA) and applicable state privacy laws, including the California Consumer Privacy Act (CCPA), as described in the Privacy Policy.
We reserve the right to suspend or terminate your account at any time, with or without notice, for violation of this Agreement, fraudulent activity, or any conduct we determine to be harmful to the Platform or its users.
You may close your account at any time by contacting us at hello@zyttle.com. Upon termination, your right to use the Platform ceases immediately. Provisions of this Agreement that by their nature should survive termination will remain in effect, including Sections 8, 9, 10, 11, and 14.
This Agreement is governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles.
Any dispute arising out of or related to this Agreement or your use of the Platform shall first be addressed by contacting us at hello@zyttle.com. We will make a good faith effort to resolve disputes informally before any formal proceeding.
If a dispute cannot be resolved informally, you agree that it shall be resolved exclusively in the state or federal courts located in North Carolina, and you consent to personal jurisdiction in those courts.
Eligibility to enter this Section. Only Parents, Adult Sitters, and Guardians who are at least eighteen (18) years of age and have the legal capacity to enter into this Agreement may agree to this Section 14.5. Teen Sitters do not agree to this Section, consistent with Section 2.
Class action waiver. You and zyttle hereby covenant and agree that any dispute, claim, or controversy arising out of or relating to this Agreement, the Platform, or any service or transaction made through the Platform shall be resolved only on an individual basis, and not as a plaintiff or class member in any purported class action, collective action, consolidated action, or representative proceeding. The arbitrator (if any) and any court may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
30-day opt-out right. You may opt out of this Class Action Waiver by sending written notice of your decision to opt out to hello@zyttle.com within thirty (30) days of the date you first accept this Agreement. Your notice must include your full legal name, the email address associated with your zyttle account, and a clear statement that you are opting out of the Class Action Waiver under Section 14.5. Opting out of this Section will not affect any other provision of this Agreement, and you will continue to be bound by all other terms.
Effect of failing to opt out. If you do not timely opt out as set forth above, you will be deemed to have agreed to this Class Action Waiver, and it will be fully enforceable against you with respect to any future dispute.
Severability. If any portion of this Section 14.5 is found to be unenforceable, that portion shall be severed and the remaining portions shall remain in full force and effect.
We may update this Agreement from time to time. When we do, we will update the effective date at the top of this page and, for material changes, notify users via email or in-app notification.
Notice to Guardians. Where this Agreement is in force as to a Teen Sitter through a Guardian's acceptance under Section 2, notice of any material change will be sent to the Guardian's email address on file. The Guardian's continued allowance of the Teen Sitter's use of the Platform after the effective date of the change constitutes the Guardian's acceptance of the updated Agreement on the Teen Sitter's behalf. If the Guardian does not accept the updated Agreement, the Guardian must withdraw consent under Section 5.2.
Notice to Parents and Adult Sitters. Your continued use of the Platform after any change constitutes your acceptance of the updated Agreement.
